Prosecutors in Kentucky have moved to permanently drop charges against Breonna Taylor’s boyfriend in connection with the bungled police raid that killed her.

The Commonwealth’s Attorney for Jefferson County filed a motion this week seeking to dismiss with prejudice the criminal charges against Kenneth Walker. 

A case dismissed with prejudice cannot be brought back before a court.

Walker had been charged with attempted murder of a police officer and assault for shooting at officers as they opened fire on the couple while serving a narcotics search warrant at Taylor’s home on March 13, 2020. 

Walker was not injured but Taylor, a 26-year-old black EMT without a criminal record, was shot eight times during the raid and died in the hallway. No drugs were found at the house. 

During an interview with police, Walker said he was ‘scared to death’ that intruders were breaking into the house, so he grabbed his legally owned gun and when the door was knocked down, he fired a shot. 

He said his intention was to fire a warning shot downward toward the ground. The bullet hit a police detective and prompted his colleagues to fire a barrage of at least 20 bullets into the house.

Taylor’s killing sparked widespread protests and led to the firings of two Louisville police detectives: Myles Cosgrove, who shot Taylor, and Joshua Jaynes, who sought the warrant for the botched drug raid.    

The charges against Walker were dropped in May 2020 due to insufficient evidence, but Tom Wine, Louisville’s top prosecutor, at the time left the door open for the prospect of presenting the case before a grand jury again following a more thorough investigation. 

In their latest motion, prosecutors conceded that state and federal investigations ‘into this matter have concluded and no new information relevant to the charges against [Walker] in this matter has been brought to the Commonwealth’s attention,’ CBS News reported. 

Louisville Sergeant Jonathan Mattingly in October of last year filed a lawsuit against Walker, accusing him of assault, battery and emotional distress.

Louisville’s top prosecutor dropped the charges against Walker in May, but did not rule out filing them again

Mattingly has blamed Walker for Taylor’s death because the officers ‘returned fire’ after he was shot in the leg. 

A hearing concerning the prosecution’s motion to dismiss charges against Walker with prejudice will take place on March 8. 

‘Every piece of evidence from when they falsely arrested and indicted him a year ago up till today prove that Kenny acted in self defense and was immune from prosecution,’ Walker’s attorney, Steve Romines, said in a statement. ‘Yet he was framed and charged to cover up Breonna’s killing. This is but a first step.’
